1. Scope and Validity

These Terms and Conditions (“T&Cs”) govern all purchases, downloads, and uses of the Glute Growth Academy (GGA) digital fitness guide (the “Product”) offered by FemFlex Studios, operating under the brand The Gym Girls’ Society (“we”, “us”, “our”).
By purchasing or accessing the Product through our website or any third-party payment platform integrated via Squarespace, you (“the customer”, “you”) agree to these Terms in full.

2. Nature of the Product and Delivery

The GGA is a digital PDF-based fitness and educational guide.
No physical items are shipped.
After payment confirmation, customers receive immediate access to download the Product via Squarespace or affiliated digital-delivery platforms.

All purchases are one-time transactions providing lifetime access to the materials as delivered at the time of purchase.
Future updates or additions may be provided at our discretion and, where applicable, will be made available to existing customers at no extra charge.

3. Pricing, Payment and Taxes

Payments are processed in U.S. Dollars (USD) through Squarespace and its integrated payment partners (including Stripe, Apple Pay, Google Pay, Klarna, etc.).

All prices shown are final prices under § 19 UStG (Kleinunternehmerregelung).
Accordingly, no VAT is charged or shown on invoices.

Prices may change at any time; such changes do not affect customers who have already completed their purchase.

4. Non-Refundable Digital Product

Because the GGA is a digitally delivered product granting immediate access, all sales are final and non-refundable.
By completing checkout, you expressly consent to immediate access and waive your statutory right of withdrawal under § 356 (5) BGB.

5. Access and Technical Responsibility

We are responsible for ensuring the functional delivery of the Product.
If you experience technical issues accessing your files, contact thegymgirlssociety@gmail.com or use the contact form on our website.
We respond within 24–48 hours on business days.

6. Intellectual Property and Usage Rights

All content within the GGA — texts, graphics, images, workout plans, branding elements, and downloadable materials — is the intellectual property of FemFlex Studios / The Gym Girls’ Society and protected by copyright law.

You receive a personal, non-transferable, non-exclusive license to use the Product solely for your own, non-commercial purposes.

You may not:

  • Share, resell, redistribute, copy, upload, or make the Product available to others;

  • Publish any portion (including screenshots or excerpts) online;

  • Use materials for commercial purposes, resale, or reproduction.

Violations may lead to legal action, access suspension, and claims for damages.

7. Health Disclaimer and Limitation of Liability

The GGA is for informational and educational purposes only.
All exercise and nutrition information is general and not individualized medical, nutritional, or fitness advice.

The Gym Girls’ Society and FemFlex Studios are not certified medical or healthcare professionals.
Before beginning any exercise, fitness, or nutrition program—including the GGA—you should consult a qualified physician or healthcare provider to ensure suitability.

By using the Product, you acknowledge and agree that:

  • Participation is voluntary and at your own risk;

  • You are solely responsible for your health, safety, and results;

  • We accept no liability for injuries, adverse effects, or unsatisfactory outcomes;

  • No specific results (muscle growth, fat loss, or body changes) are guaranteed.

To the fullest extent permitted by law, FemFlex Studios and The Gym Girls’ Society disclaim all liability for any direct or indirect damages, injuries, or losses resulting from use or reliance on the Product.

8. Testimonials and Promotional Use

We may collect testimonials or feedback only after obtaining explicit consent from the individual.
Approved testimonials may be used for promotional purposes on our website, emails, and social media.

9. Modifications and Updates

We reserve the right to modify or enhance the Product, pricing, or materials at any time.
Such modifications will not affect existing customers, except to provide optional updates or improvements.

10. Data Protection

We collect and process personal data only as required to fulfill purchases and communications through Squarespace and, in the future, via email-marketing tools such as Mailchimp.
Data is handled per EU and German GDPR rules.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.
